1) Acceptance
By using EbooksLaunch (“we,” “us,” “our”) and our site at ebookslaunch.com, purchasing any services (EPUB/PDF formatting, accessibility audits, related consulting), or submitting files, you agree to these Terms.
2) Services
- Formatting: DOCX → reflowable EPUB and, if requested, print-ready PDF.
- Accessibility: WCAG 2.1 AA and EPUB Accessibility 1.1 checks with a practical report.
- Delivery: Typical window is 48–96 hours after kickoff confirmation; complex layouts may require more time.
3) Your Responsibilities
- Provide complete and lawful materials (text, images, fonts) with necessary rights to use and distribute.
- Confirm metadata, ISBN(s), retailer targets, and any special accessibility preferences.
- Back up your files; we’re not a file storage provider.
4) Payments & Refunds
- Payments are processed by third parties (e.g., PayPal). We don’t store card data on our servers.
- Refunds: Before work begins: full refund. After kickoff confirmation and initial work has started: pro-rated refund at our discretion based on work completed. Completed/approved deliverables are non-refundable.
- Chargebacks for delivered work may result in account suspension and IP enforcement for our materials.
5) Intellectual Property
- You retain all rights to your manuscript and supplied assets.
- We grant you a non-exclusive license to use our formatting output in connection with your book distribution.
- Our trademarks, brand assets, templates, and internal processes remain our exclusive property.
6) Approvals & Revisions
- Each package includes a defined round of revisions for formatting or accessibility fixes within the agreed scope.
- Material scope changes (new chapters, images, layout redesign) may require a change order or upgrade.
7) Prohibited Use
You agree not to submit unlawful, infringing, or harmful content; not to attempt security bypasses; and not to use our deliverables for illegal purposes.
8) Disclaimers
Services are provided “as is.” We do not guarantee retailer acceptance, sales performance, or third-party platform uptime. We aim for best-practice accessibility but cannot warrant conformance for future platform changes.
9) Limitation of Liability
To the maximum extent allowed by law, our aggregate liability for any claim is limited to the amount you paid for the service giving rise to the claim.
10) Privacy
Your privacy is important. See our Privacy Policy for how we handle data and files you provide.
11) Governing Law
These Terms are governed by the laws of Texas, USA (update this if you operate elsewhere). Disputes will be resolved in the courts located in Texas.
12) Changes
We may update these Terms at any time. Updates become effective upon posting. Continued use constitutes acceptance.
